Terms of Use of Namsu GmbH

    The web-based application namsu.ch (hereinafter also: web-based application or Application) is operated by Namsu GmbH (hereinafter: Namsu) based in Uetikon am See. With its product namsu.ch, Namsu offers a web-based application for handling the application process to an apartment advertised by Namsu (on behalf of its client).

    By accessing the application namsu.ch you as a user (hereinafter: user) agree to the following terms of use. If you also conclude a contract with Namsu GmbH for the products Namsu Smart, the General Terms and Conditions of Contract of Namsu GmbH shall apply in this respect in their currently valid version.

    To improve the readability of these terms of use, the masculine and feminine forms are not both used. If only the masculine form is used, this always expressly includes the feminine form.

  1. Use of the application
  2. The functions of the application are available to all users only after successful registration. If you register as a user on namsu.ch, you expressly agree to receive e-mails from Namsu to the e-mail address you have provided.

    No fee is charged for using the application to submit an application to an advertised apartment. In this regard, there is no claim to selection of the submitted application at any time. With regard to data protection, full reference is made to the privacy policy of Namsu in its currenty valid version (cf. item 6 of these Terms of Use).

    If the user applies for a broker apartment, which has been brought to him via the habitabell.ch portal, the contractual conditions agreed within this framework, which can be accessed via the habitabell.ch portal, apply. Users of habitabell.ch who apply for a rental apartment from the habitabell.ch portfolio via namsu.ch are expressly informed of this by means of a notice. If the user then submits his application for a rental apartment from the habitabell.ch portfolio via namsu.ch, he undertakes to pay the agreed broker's fee when the rental contract is issued.

  3. Liability
  4. Any liability for damages arising from or in connection with the technical use of the Application is excluded to the extent permitted by law.

    The respective user is solely and exclusively responsible for the content of the documents uploaded by using the Application. Uploading documents with legally inadmissible or criminally relevant content is strictly prohibited and will be legally prosecuted.

  5. Rights Namsu
  6. Namsu reserves the unilateral right, at any time, to modify and/or permanently or temporarily discontinue, in whole or in part, without notice any features of the Application that can be used for free.

    If Namsu determines an abusive use of the Application, Namsu reserves the right to block a user's access to and the use of the Application.

  7. Third party links
  8. The links to third-party providers contained on namsu.ch are not checked for accuracy, appropriateness or completeness. The third party provider is solely responsible for the content of the corresponding websites. The contents of these websites are beyond the responsibility of Namsu. No liability is assumed for the contents and the correct functioning of such websites (websites of third parties that can be reached via a link).

  9. Technical support
  10. In case of technical problems concerning the functioning of the Application, users who have applied with their Namsu application code to a property advertised by Namsu have the possibility to contact the support team of Namsu at any time. For this purpose, an email with a description of the underlying technical problem must be sent to support@namsu.ch [and, if possible, supported by screenshots. Namsu guarantees to handle the problem within 24 hours after receiving the email.

  11. Data protection
  12. Data protection is governed by Namsu's privacy policy in its currently valid version. The privacy policy for the use of the application namsu.ch can be accessed via the following link: Privacy Policy

  13. Modification clause
  14. Namsu reserves the right at any time to amend these General Terms and Conditions to the extent permitted by law. The current binding version of the General Terms and Conditions can be accessed via the homepage (namsu.ch).

  15. Severability clause
  16. Should parts of a provision or a provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions of these General Terms and Conditions.

  17. Place of jurisdiction and applicable law
  18. For all disputes arising from or in connection with the use of the Application, the ordinary courts at the registered office of Namsu shall have exclusive jurisdiction. Applicable law is exclusively the substantive Swiss law (excluding international private law).
